Terms of sale and use
Last updated October 23, 2026
These terms are an agreement between you and Banton Labs Inc., a company incorporated in Ontario, Canada ("Banton Labs", "we", "us"). They cover the Dusk desktop application, its updates, the free plan and the Dusk license. By installing or using Dusk, or by buying a license, you agree to them. If you use Dusk for an organization, you agree for that organization too.
1. Summary
- Dusk is free to use within a weekly word limit. A license removes the limit for a one-time price.
- A license is for one person and works on up to 3 of that person's computers at a time.
- A license never expires and includes every update we publish in the 12 months after you buy it. After that, you keep using the versions you have.
- Support is by email, on a best-effort basis.
- You can get a full refund within 30 days of buying, for any reason.
- Dusk runs on your computer. We don't receive your recordings, your text or your history.
- Speech and language models are made by other companies and come with their own licenses.
This summary is for convenience. The sections below are the terms.
2. The software
Dusk is licensed, not sold. Banton Labs and its licensors keep all rights, title and ownership in Dusk,
including its code, design, name and logo. Dusk includes open-source components, each used under its own
license; their licenses are listed in the file THIRD-PARTY-NOTICES.txt that comes with Dusk
and on the About page in the app. Nothing in these terms limits your rights under those licenses.
3. The free plan
You may download Dusk and use it free of charge within the weekly word limit shown in the app. Every feature works on the free plan; when the week's words are used, dictation and commands stop until the next week begins. We may change the free plan's limits in future versions of Dusk. The free plan has no support commitment.
4. The license
Subject to these terms and to paying the price, we grant you a license that is:
- Personal: for one named person, who may use Dusk with the license on up to 3 computers they own or use at a time. You can remove a computer, on Dusk's About page or in Polar's customer portal, to use the license on another. An organization buys one license for each person who uses Dusk.
- Perpetual: it doesn't expire and has no subscription fee. You may use every version of Dusk released up to 12 months after the date of your purchase, for as long as you like.
- With 12 months of updates: your license covers every update we publish in the 12 months after your purchase, including versions for other operating systems released in that time. Later versions may require a new purchase; if we offer upgrade pricing, it will be shown on our website. We aren't obliged to publish updates, and the license doesn't promise particular future features, or support for operating systems or hardware that Dusk doesn't support today.
- Non-exclusive and non-transferable: you may not sell, share, lend or publish your license key.
- For any lawful purpose, personal or commercial.
5. What you may not do
Except where the law gives you a right that can't be limited by agreement, you may not:
- circumvent, disable or alter the word limit, the license check or the computer limit, or help others do so;
- copy, decompile, reverse engineer or modify Dusk, other than the open-source components under their own licenses;
- rent, resell, sublicense or redistribute Dusk or license keys, or offer Dusk as a hosted service;
- use Dusk to break the law or to record other people without the consent the law requires.
You may share the link to our website, and you may keep copies of the installers for your own use.
6. Buying, payment and taxes
Licenses are sold through Polar Software Inc. ("Polar"), our reseller and merchant of record. Polar processes the payment, charges the applicable sales tax, VAT or GST, and issues your receipt, under its own terms of service and privacy policy. The price is shown at checkout before you pay. Your license key comes on your receipt and in Polar's customer portal.
7. 30-day refund guarantee
If Dusk isn't right for you, ask for a refund within 30 days of your purchase and you get the full amount back, for any reason. Write to [email protected] with the email address you bought with, or ask through Polar's customer portal. The refund goes to the original payment method, and the refund ends your license: we revoke the key, and Dusk is used on the free plan again. After 30 days, purchases are not refundable, except where the law requires otherwise.
8. Speech and language models
Dusk works with speech and language models made by other companies. Models aren't part of Dusk: you choose them in the app, which shows each model's license, and downloads them from their publisher's servers. Your use of a model is governed by its license, which is between you and its publisher. We don't own or control the models and make no promise about their availability or about the text they produce.
9. Your content and your computer
Your recordings, your text, your history and your settings stay on your computer and remain yours. Our privacy policy describes the few connections Dusk makes. Voice commands act on your computer: they open applications and websites, press keys and type text. Dictation and commands can be wrong. Check text before you send it, and don't rely on Dusk where a mistake could cause harm, such as in emergencies, medical decisions or controlling machinery.
10. Updates
Dusk checks for new versions and tells you when one is available; you can turn the check off in Settings. Dusk never installs an update unless you choose to. Which updates your license covers is set out in section 4. We may stop publishing updates or stop selling Dusk at any time. If we do, your license keeps working with the versions you have.
11. Support
We help license holders by email at [email protected] on a best-effort basis: we're a small team and answer as soon as we can, but we don't guarantee a response time or a fix for a particular problem, computer or application. The free plan has no support commitment. Problems can also be reported publicly on our releases page on GitHub.
12. Warranty
Apart from the refund guarantee, Dusk is provided "as is" and "as available". To the fullest extent the law allows, Banton Labs disclaims all warranties and conditions, express or implied, including merchantability, fitness for a particular purpose, non-infringement and that Dusk will be accurate, uninterrupted or free of errors.
13. Limitation of liability
To the fullest extent the law allows, Banton Labs is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, or business, arising from Dusk or these terms, even if we were told they were possible. Our total liability for any claim is limited to the amount you paid for your license, or 50 Canadian dollars if you use the free plan.
14. Your rights as a consumer
Some places don't allow the exclusions in sections 11, 12 and 13, or give consumers rights that can't be waived. Where that applies to you, those rights remain, and the exclusions apply only as far as the law allows.
15. Ending these terms
You may stop using Dusk at any time by uninstalling it. If you materially breach these terms, for example by sharing your license key publicly or circumventing the word limit, we may revoke your license key after telling you why. Sections 2, 5, 8, 12, 13, 16 and 17 continue after these terms end.
16. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply. The courts of Ontario have jurisdiction over disputes, except that if you are a consumer, you may also bring a claim in the courts where you live.
17. General
- You must follow the export and sanctions laws that apply to you, and may not use Dusk in a country or by a person those laws restrict.
- We may update these terms. We post the new version here with a new date; the version in force when you bought your license continues to govern that license's scope and price.
- If a part of these terms can't be enforced, the rest still applies.
- These terms, the privacy policy and the open-source licenses in Dusk are the whole agreement about Dusk.
- Not enforcing a term right away doesn't mean we give it up.
